Paint by Fingers: Terms & Conditions

By downloading or using Paint by Fingers (the app), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app.

You are not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Trimensio Limited.

The app is provided “as is” without warranties.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial use only, subject to these Terms.

Purchases & In-App Content
If the app includes optional paid content:

  • All purchases follow Meta Quest Store policies.

  • Refunds must be handled through Meta.


We reserve the right to update or change available content at any time.

User-Generated Content

Your drawings, paintings, and creative output are your property.

You retain all rights to your artwork. The artworks are stored locally, and are not managed by us.


By using the app, you confirm that your content:

  • Does not infringe others’ rights

  • Does not contain illegal material

We do not claim ownership of your artwork.

As the artworks are saved locally, you might lose your access to them in case you lose access to your device.

App Updates

Trimensio Limited is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason.

While we try our best to keep user-generated save files compatible with the future versions, this cannot be guaranteed. Trimensio Limited has no obligation to keep the save files compatible with the future application updates.

Personal Data

Spira app may store and process personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your device and access to the app secure. Please refer to our privacy policy for more info.

App Use

Trimensio Limited cannot always take responsibility for the way you use the app. For example, you need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, we cannot accept responsibility.

Health & Safety Warning

The app requires some physical movement in mixed reality around your real space. Although the app will do its best to provide you with the best experience, it is your own responsibility to ensure you, and others who you may show the app to, stay aware of your playspace while playing the app, and that the playspace is safe to play in. Always remain aware of your surroundings and stop immediately if you experience discomfort, dizziness, or loss of balance. You will not hold Trimensio Limited or the platforms the app may run on responsible for any personal injury or damages resulting from playing the game.

Third-Party Information Disclaimer

With respect to Trimensio's responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Trimensio Limited accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

App Updates and Termination

We may update the app from time to time to improve functionality, add features, or comply with system requirements. These updates may be necessary for the app to continue working properly. By using the app, you agree to install any updates when they are made available. Please note that Trimensio Limited does not guarantee that the app will always remain compatible with your device or that updates will meet your specific needs or expectations. We may, at our discretion, discontinue the app or suspend your access to it at any time. Where possible, we will provide notice before doing so. If the app is discontinued, your right to use it will end, and any rights and licenses granted under these Terms will be revoked. You are responsible for uninstalling the app from your device if we terminate its availability.

Liability

To the maximum extent permitted by law:

  • We are not responsible for loss of data, loss of revenue, or device damage.

  • The app is provided without warranties of fitness or reliability.


Governing Law
These Terms are governed by the laws of United Kingdom. Any disputes will be handled by the courts of United Kingdom.

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
